Website: Refers to the website owner/operator Industracom Pty Ltd (www.industracom.com, Australia ABN 20 079 858 236) operators of IndustrySearch.com.au and MedicalSearch.com.au and HospitalityHub.com.au.


Supplier marketing packages

These are the standard terms & conditions for our Storefront Packages that are accepted either via processing an online payment following receipt of a Storefront package confirmation via email, signing up to a Storefront package via one of our online pages, or with the confirmation phrases 'Activate My Storefront', 'Renew My Storefront' and/or 'Upgrade My Storefront', meaning you are entering into an agreement with the website or an authorised representative, and as an advertiser you are bound to these terms and conditions:

  • You agree to adhere to the parameters of the package you maintain with us.

  • We maintain the right to revise our packages as required.

  • We maintain the right to deny any organisation from being on our platform.

Definitions
Website/We: refers to the website owner/operator - Industracom Pty Ltd - www.industracom.com.
Company: refers to a business maintaining a Storefront on our website.
Packages: refers to the Storefront service provided.

Terms of use
The website provides digital marketing and commerce services which are to comply with the following terms of use:

  • Companies must be registered entities as required by the website;

  • Products and services on offer must be lawfully acquired;

  • Products and services on offer must be of a legal nature;

  • Companies must not make untrue or unsubstantiated claims on the website;

  • Companies must be committed to providing adequate service and support to their customers;

  • Companies must comply with commercial law in the regions where business is conducted;

  • Companies must clearly define its purpose, products and/or services;

  • Companies' promotional information must adhere to international copyright and trademark law;

  • Companies must have authorisation to promote and market advertised items;

  • If the advertiser is exclusive to a specific geographic region they should make it clearly evident;

  • Companies of adult or gambling products and services are not permitted on the website.

  • We allocate category inventory based on balancing the customer’s performance with platform-wide supply/demand. If a category has reached capacity, we reserve the right not to feature a customer’s products in that category until more capacity is made available, but will feature the customer’s products in all other related categories to increase sales opportunities.

Billing & payment
By entering into a contract through one of the following methods: fax, e-mail, phone or online, companies are legally bound and obligated to adhere to the payment terms and conditions of the website.

The website maintains a credit collection process. Overdue accounts (60 days+) may be referred to a credit collection agency.

Monthly subscriptions

  • Monthly subscriptions have a 12 month minimum term starting from the first successful payment.

  • Upgrading a Storefront during the minimum term is possible, downgrading is not.

  • If the monthly payment option is selected, direct debit is required upon booking.

  • The first monthly payment is required prior to setup unless otherwise agreed in writing.

  • Monthly payments are continuous until cancelled in writing following the minimum term.

  • Thirty days notice is required for cancellation.

  • If a monthly package is cancelled or payment is not processed, rankings and content may be reset.

All subscriptions/upgrades

  • Payment is required within 14 days of booking, unless otherwise agreed in writing.

  • A renewal/upgrade offer may be made following the minimum term.

  • Renewals/upgrades will only take place once approval is received; If approval is not received before the expiry date, the offer will expire.

  • Any periodic price review will be communicated to the main contact on file via email ahead of it taking effect.

  • Customer is to notify us of any change in bank account details.

All Access Storefronts

  • Categories on our platform are organised by the cost/value of the products in them. Many categories on our platform feature high value equipment, however categories with lower value products such as consumables are called ‘Transactional’ categories, as they are:

    • Easier for buyers to understand and make decisions on buying

    • Quicker purchases

    • Repeat purchase

    • Often ordered in bulk

  • If you mainly sell consumable products and are eligible for an All Access Storefront, please note:

    • You are agreeing to an All Access Storefront being completely self-service so there is no dedicated account manager, however you have all the tools to easily set up and start reaching buyers in minutes.

    • The products you are allowed to feature are as initially agreed and must belong only to Transactional categories (defined generally as individual products of $200 or less in value).

    • If you feature 1 or more higher value products (greater than $200 as a general guide), you are agreeing to advise us first. Your Storefront will no longer be considered to be solely in Transactional categories and at which point you may be charged at a full Storefront price going forward. This will be agreed with you first.

Categorisation
The website's directories and categories are under constant development and improvement in consultation with industry experts and customers. The website reserves the right to edit or include categories and related content at its discretion. Companies can make category suggestions for assessment by our editors. 

Category Ranking
Within categories, our website maintains a supplier loyalty ranking system which works in two ways:
1. Package Level - Companies and products on higher packages are listed above lower packages;
2. Activation Date - If two companies are on the same package, the longest active company will be preferentially listed
3. Engagement Rank - Factors in how well a product featured in the category is engaging/performing based on views to enquiries Click-Through-Rate vs the products in the category it’s featured in.

Search Engine Optimisation
We apply the latest and most effective optimisation techniques however rankings on search engines cannot be guaranteed and may change over time. Companies are recommended to apply our optimisation guidelines to improve their content's search rankings.

Platform Sponsorship
Sponsor logos and banners are showcased in the most relevant and/or agreed locations (including but not limited to home page, directory, category pages). Additional directory sponsorship placements can be purchased. The size and position of logos and banner placements are based on the package level. In our newsletters and on some areas of the website a rotational sponsor placement is displayed.

Our platforms are constantly evolving and being re-designed to drive the most optimal outcomes for Buyers and Suppliers - hence we reserve the right to makes changes without prior notice. Suppliers understand that platform changes across the board supersede any prior arrangement including but not limited to logos, banners or featured placements.

Content Pages/Items
Depending on the package level, Storefronts have the capacity to feature a designated number of content pages, including: products, solutions and articles. Each content page has the ability to host videos and pictures. File, text and image sizes must comply with our system specifications.

Followers
You get to build a network of Followers to keep in touch with. Followers receive a monthly email keeping them up to date with what's new from Storefronts they are following. To grow your followers you can add a FOLLOW BUTTON to your own website or email signature.

Storefront Management
Storefront owners receive a username and password to access a Supplier Panel where content can be maintained and results can be monitored.
- Our User Guides & Ongoing Emails help you understand how best to utilise your Storefront.
- You can also access support and assistance from our team anytime.

Tracking & measurement
Storefronts generate click statistics and other information so you can track and measure your results. These are accessible anytime in the Supplier Panel.

Hot Products
Hot Products are an additional paid advertising service. Companies must be a current Storefront owner to purchase Hot Products.

System maintenance
The website takes all reasonable steps to ensure the service is properly maintained and kept up-to-date to protect against the loss, misuse and/or alteration of customer information.

Data backup
The website backs up customer data onto backup equipment regularly but is not liable for the loss of data.

System rights
Companies do not obtain rights to our hardware, software, code, data and other infrastructure provided other than expressly defined as part of the package.

Liabilities and warranties
Our company, its subsidiaries, employees, partners and suppliers are not liable for: 
(i) any indirect or incidental damages of any kind; 
(ii) any damages including those resulting from:
(a) loss of use, data/information, revenue or profits, on any case amounting out of or in connection to the use (or inability of use) of the service; 
(b) the statements of any employee of the website; 
(c) any unauthorised access to or modification of the customers website or package; 
(d) any data or information that is sent or received or not sent or received; 
(e) any failure to store data, information files or other related content; 
(f) fraudulent, negligent or otherwise unlawful behaviour; 
(g) information, data or other material provided to the website.

Privacy policy
Customers agree to adhere to our privacy & information policies.

Rights and responsibilities
The customer is responsible for dealing with persons who access the customer data and information and will not attempt to refer complaints, feedback or comments in relation to this data and information to the website. The customer will cover the website against all possible costs, expenses, loss or liability that may directly or indirectly result from:

a. the customer breaching these terms set out;
b. the customer, or any person using the website's customer account or misusing the service;
c. the publication of offensive or unlawful material on any part of the website in using the service.

Suspension and termination
We reserve the right to suspend the service and/or disconnect or deny access to the service either during technical failure or maintenance procedures or if customers fail to comply with terms and conditions or do anything which in the website's frame of view or opinion may affect or undermine the operation of the website.

Logo & brand use
By featuring on our website (including Storefronts and Basic Profiles) you agree that we may use your logo or company brand in marketing material from time to time as a way to add value to the partnership.

General
These Standard Terms & Conditions are governed by the laws of New South Wales, Australia. Our failure to exercise or to enforce any right or provision of the Agreement will not constitute a waiver of such right or provision.

Unsolicited & unlawful offers
Requests placed with companies listed on the website must be of a legal and lawful nature and must be in relation to the nature of business conducted by the listed company. We strongly deter individuals from using the website's communication facilities to solicit businesses in relation to items which have not been requested (i.e. unsolicited offers). We do not assume responsibility or liability for the nature or content of enquires that come through our website.


Campaign advertising services

These are the standard terms & conditions for the website's campaign advertising services. By entering into an agreement with the website or an authorised representative via confirmation of the phrase 'Confirm My Email Marketing' or 'Confirm My Hot Products', advertisers are bound to these terms and conditions:

  • Advertisers agree to adhere to the parameters of the advertising package they purchase.

  • The website maintains the right to revise advertising packages as required.

  • The website maintains the right to deny any organisation from advertising.

Definitions

Advertiser: refers to the business purchasing advertising on the website.
Packages: refers to the advertising package purchased.

The website provides online advertising and marketing services to comply with the following terms of use:

Billing & payment
By entering into an agreement for advertising services, advertisers are bound and obligated to adhere to the terms and conditions of the website. The website maintains a credit collection process. Overdue accounts are referred to a credit collection agency. This could affect an advertiser's credit rating therefore all reasonable efforts are made to collect outstanding payments before action is taken.

Cancellation policy
Due to limited advertising inventory, cancellations within 60 days of campaign dates are not refundable and outstanding invoices remain payable. Clients can reschedule campaigns to alternative dates at no additional fee. Rescheduling must take place prior to the initial campaign run date and must be for an alternative run date within 180 days. Payment would still be due as per the original booking dates/terms.
